General Terms and Conditions of Sale for LuminusWear

1. Definitions

1.1 LuminusWear: The registered trade name under which the company operates.
1.2 Customer: The natural or legal person purchasing products from LuminusWear.
1.3 Products: All sportswear and related items offered by LuminusWear.
1.4 Limited Edition: A special product with a unique serial number and certificate of authenticity.
1.5 Membership: A subscription that provides exclusive access to products, personalized services, and loyalty rewards.
1.6 Loyalty Account: A personal account used to earn and redeem points for exclusive products and benefits.

2. Applicability

2.1 These terms and conditions apply to all offers, orders, and agreements with LuminusWear.
2.2 By placing an order, the customer agrees to these general terms and conditions.

3. Exclusivity and Orders

3.1 Each purchase is considered an investment in rare, high-quality sportswear.
3.2 Only customers with a valid membership have access to the purchasing platform.
3.3 A binding agreement is formed upon acceptance of the order by LuminusWear. LuminusWear reserves the right to refuse orders or impose additional conditions.

4. Memberships

4.1 LuminusWear offers various membership levels, each with unique privileges as described on the website.
4.2 Monthly costs range from €42 to €442 depending on the chosen level.
4.3 Members receive access to exclusive collections, store credit, personal styling, and other premium benefits.
4.4 Memberships are personal and non-transferable, unless explicitly allowed for certain levels after verification.
4.5 Memberships can be canceled at any time without a notice period.
4.6 Subscriptions are available on a monthly, quarterly, or annual basis.
4.7 Membership fees are automatically debited at the start of each billing cycle.

5. Prices and Payment

5.1 All prices are in euros (€) and include VAT unless otherwise stated.
5.2 Accepted payment methods include PayPal, iDEAL, Visa, Mastercard, American Express, Apple Pay, and Google Pay.
5.3 LuminusWear reserves the right to adjust prices. Price changes do not affect orders already confirmed.

6. Delivery

6.1 Each LuminusWear item is hand-designed and crafted with precision. Therefore, a premium delivery time of up to four (4) weeks applies from the order confirmation.
6.2 All shipping costs are fully covered by LuminusWear.
6.3 LuminusWear is not liable for delays caused by circumstances beyond its control, such as customs, natural disasters, or force majeure.
6.4 Every order is securely shipped with tracking, insurance, and an embedded GPS tracker. Customers may opt out of GPS tracking upon request.
6.5 For security reasons, all deliveries require identity verification and a signature upon receipt. Delivery only occurs at the registered address.

7. Returns, Cancellations, and Warranty

7.1 Customers may cancel their order before shipment.
7.2 Customers may return non-personalized products within 30 calendar days of receipt.
7.3 Personalized or custom-made items are excluded from return once the order is confirmed.
7.4 Returns must be complete, in the original luxury packaging, including any gifts, certificates, and receipts.
7.5 LuminusWear covers return costs. A return label is included in the package.
7.6 All products come with a one-year warranty covering material and manufacturing defects.
7.7 Complaints must be reported within a reasonable period after discovery.
7.8 LuminusWear will, at its discretion, repair, replace, or refund the product.

8. Exclusivity and Serial Numbers

8.1 All LuminusWear products are exclusive and come with a unique serial number and corresponding certificate of authenticity.
8.2 This certificate is linked to the original buyer and registered in LuminusWear's internal database.
8.3 Serial number verification may be requested by the customer.

9. Luminus Loyalty Program

9.1 Customers earn Luminus points through purchases and actions as described in the loyalty program.
9.2 Points can be redeemed for access to collections and limited releases.
9.3 Full program terms are available on the official LuminusWear website.

10. Liability

10.1 LuminusWear is not liable for indirect damage, including loss of profit, data loss, or missed business opportunities.
10.2 Liability is limited to the purchase value of the relevant product.

11. Privacy and Data Protection

11.1 LuminusWear processes personal data in accordance with the GDPR and applicable Dutch laws.
11.2 Data is used solely for order processing and communication with customers.
11.3 Personal data will not be shared with third parties without explicit consent, except as required for order fulfillment or by law.
11.4 Customers have the right to access, correct, or delete their data. Full details are available in our Privacy Policy.

12. Cookies

12.1 Cookies are used to improve the user experience and analyze website traffic.
12.2 Cookie usage complies with the Dutch Telecommunications Act and the GDPR.
12.3 Essential cookies are used by default. Non-essential cookies are only used with consent and can be managed via cookie settings.

13. Product Descriptions and Availability

13.1 LuminusWear strives for accurate and up-to-date product descriptions.
13.2 Slight variations may occur due to artisanal production and unique materials.
13.3 If a product is unavailable after ordering, the customer will be informed and offered an alternative or refund.

14. Order Confirmation and Invoicing

14.1 Customers receive a digital order confirmation after purchase.
14.2 An official invoice including VAT and shipping costs is provided once the order is processed.

15. Complaints Procedure

15.1 LuminusWear is committed to outstanding customer service.
15.2 Complaints can be submitted via info@luminuswear.com and will be processed within 14 days.
15.3 If further investigation is needed, the customer will be informed of the expected response time.

16. Right of Withdrawal

16.1 Customers have the right to cancel their order before shipment.
16.2 Once an item has been shipped or personalized, this right no longer applies.
16.3 A withdrawal form can be provided upon request for standard purchases not yet shipped.

17. Applicable Law and Disputes

17.1 All legal relationships between LuminusWear and the customer are governed by Dutch law.
17.2 Disputes are preferably resolved amicably. If this is not possible, disputes will be submitted to the competent court in the Netherlands.

18. Changes to the Terms

18.1 LuminusWear reserves the right to modify these terms.
18.2 Changes take effect upon publication on the official website.

20. Intellectual Property

20.1 All product designs, digital content, brand names, texts, and visuals from LuminusWear are protected and remain the property of LuminusWear or its licensors.
20.2 Reproduction, distribution, or commercial use without written permission is strictly prohibited.

21. Force Majeure

21.1 LuminusWear is not liable for shortcomings or delays due to force majeure, including natural disasters, war, cyberattacks, pandemics, government actions, strikes, or delivery issues beyond its control.

22. Digital Access and Limited Time Windows

22.1 Access to LuminusWear’s most exclusive product releases may be granted via time-limited digital access (e.g., 21.42 minutes).
22.2 These invitations are unique, non-transferable, and automatically expire after the access window closes.
22.3 Attempting to share or bypass access links may result in account restriction or termination.

23. Digital Certificates and Blockchain

23.1 Some Limited Edition items may include a digital certificate of authenticity stored via blockchain or similar technology.
23.2 Ownership transfers require identity verification and may require re-registration for valid certification.

24. Access and Membership Transfers

24.1 Access, memberships, and invitations are strictly personal and may not be resold or transferred without written permission from LuminusWear.
24.2 Transfers are only permitted for specific membership levels and must be processed through the internal protocol.
24.3 Unauthorized transfer or resale may result in permanent exclusion from future access.
